Illinois’ Commitment to Justice

Illinois’ Commitment to Justice

In 2025, Illinois will implement new regulations aimed at expanding access to justice for individuals with limited English proficiency (LEP). By requiring professional interpreters during administrative hearings, these changes prioritize inclusion and fairness for all residents.

At Kaplan Interpreting Services, we recognize this as an important development that not only benefits LEP individuals but also reinforces the critical role interpreters play in ensuring effective communication in legal and administrative settings.

What the Law Means for Illinois Residents

The new law ensures that all residents, regardless of their language, can effectively participate in administrative hearings that often address essential matters like public benefits, housing, and employment.

Here’s how:

  1. Guaranteed Interpreter Access: LEP individuals, including self-represented or low-income participants, will have access to interpreters for every stage of state administrative hearings. This ensures that language barriers do not hinder individuals from presenting their case or understanding their rights.
  2. Free of Charge: Interpreter services will be provided at no cost, removing financial barriers that have historically limited access to justice for many residents.
  3. Emphasis on Quality and Accuracy: The law requires the use of certified or qualified interpreters to guarantee accurate, impartial communication. Untrained individuals or family members are no longer acceptable substitutes, ensuring professionalism and reliability.

Why This Matters: A Step Toward Inclusion

These regulations reflect a broader commitment to fairness and equity, aligning Illinois with best practices already in place in other states.

  • Supporting LEP Residents: Language should never be a barrier to justice. This law ensures that all residents can fully engage in proceedings that affect their rights and livelihoods.
  • Raising Industry Standards: By emphasizing certification and professionalism, the regulations enhance the credibility and impact of interpreters across Illinois.
  • Building Public Trust: Access to qualified interpreters fosters greater confidence in state agencies and their commitment to serving all residents equitably.

How Agencies and Professionals Can Prepare

To comply with the new law, state agencies and legal professionals must:

  • Engage Certified Interpreters: Ensure access to professionals who meet the required standards of training and certification.
  • Update Policies: Develop comprehensive language access plans to streamline interpreter use and address the needs of LEP individuals.
  • Provide Training: Equip staff to recognize language needs and work effectively with interpreters.

Failure to meet these requirements could lead to procedural delays, appeals, or challenges, making preparation essential.

Alexandra Kaplan

CEO & Founder

Born in Dallas, Texas, Alexandra grew up surrounded by Spanish, English, Arabic, and Italian. After moving to Venezuela, Spanish became her primary language. She holds a Master's in Healthcare Administration from Washington University in St. Louis and is a California court certified and medical interpreter.

She founded Kaplan Interpreting Services after seeing an industry that treated interpreters as interchangeable and clients as ticket numbers. She built a protocol-driven operation where every interpreter is hand-selected and credentialed for the specific setting, every client has a dedicated point of contact, and risk management is built into every assignment.

Her career reached a historic milestone when she interpreted the conversation between President-elect Biden and Pope Francis. That assignment, along with engagements for Nike and the Summit of the Americas, set the standard for every client engagement that followed.

"The same protocols that protected that historic conversation now protect every assignment we handle."
